Call To ACTION: A Directive To Participate In ACTIVE’s H.R. 450 Political Operation

First of all, if you haven’t joined ACTIVE, please do so immediately.

One of the missions of ACTIVE is to bring to light and end the transgressions perpetrated, against our Constitution, by the Federal Government. One of the most fundamental concepts of our Constitution is the limitation of power placed on the government by the Constitution. These powers are laid out in Article I, section 8, clauses 1-18 of the Constitution. These powers have been increased without regard to the amendment process laid out in Article V. By increasing the powers of the government, with impunity, the government is now operating well outside their Constitutionally mandated limitations.

There is currently a bill, H.R. 450, that has been referred to the House Subcommittee on the Constitution, Civil Rights, and Civil Liberties. Here this bill sits. The name of the bill is “The Enumerated Powers Act” and was introduced on 9 January, 2009 by Rep. John Shadegg of Arizona. This subcommittee refuses to take any action on this Bill as it would require a change in Chapter 2 of Title 1, U. S. Code to include a new section which would read:

` Sec. 102a. Constitutional authority clause

`Each Act of Congress shall contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act. The failure to comply with this section shall give rise to a point of order in either House of Congress. The availability of this point of order does not affect any other available relief.’

This bill would require Congress to inform the American People if the legislation being proposed was Constitutional or not. This bill will die in committee unless the American people require action on this bill. This bill currently has 47 cosponsors and many more are needed. By all rights, if our Congress was willing to uphold their oaths of office this bill should have 434 cosponsors. This is not the case. I am ordering all members of ACTIVE to call and write their elected representatives to demand they cosponsor and vote for this bill. (Write your letter within ACTIVE guidlelines, which is to say, write it with ACTIVE letterhead which is available, via email or real mail, through your immediate superior or the National Printed Materials Officer, Dina Wilson. To understand why it is necessary to write the letter under the ACTIVE imprimatur, read the appropriate guideline on the Rules and Regulations page of the ACTIVE website.) If they do not, we will know the ones that are thumbing their noses at the United States Constitution and their constituents. I will be following the progress of this bill and will be posting the names of those who take their duty as United States Congressman seriously. The current list of cosponsor is:

If your Representative is on this list contact them and thank them for upholding their oaths and defending the Constitution of the United States. If they are not on the list contact them and tell them you want them to cosponsor this bill. This is one thing we can do to get the ball rolling to return the United States to the Constitutional Republic that was envisioned by our Founders. Become ACTIVE!!

Sincerely,

Tim Kerlin
